MRP Rs. 630 on 500 ml sanitizer, FIR lodged under EC Act: FDA Haryana

A FIR has been lodged by Officer of FDA Haryana at Hisar, Haryana under Essential Commodities Act (EC Act) for fixing MRP 630/- on 500 ml bottle of Sanitizer amid Govt has already notified the MRP of sanitizer as Rs. 100/- per 200 ml bottle of sanitizer. Suresh Chaudhary, Drugs Control Officer, (DCO) Hisar, Haryana lodged the FIR today at Hisar.

Narender Ahooja, State Drugs Controller (SDC), Haryana on the direction of Ashok Kumar Meena, Commissioner, FDA Haryana (CFDA) constituted the team and directed the team to act as soon as possible under the quidance of Manmohan Taneja, Asstt. State Drugs Controller, Haryana.

MRP Rs. 630/- on 500 ml Bottle

The team comprising of Raman Sheoran, Senior Drugs Control Officers (SDCO), Hisar Zone, Hisar, Suresh Choudhary, Drugs Control Officer, Hisar and Satbir Singh, ILM, Hisar visited Rakshit Pharma, Hisar. The team found stocked hand sanitizer, brand name Bactorub Blue (Alcohol Rub in Hand Disinfectant), having MRP Rs. 630/- on 500 ml Bottle of the sanitizer. This Sanitizer was manufactured & marketed By Raman & Weil Pvt. Ltd, Daman.

Manoj Kumar proprietor of Rakshit Pharma, Hisar had purchased these sanitizers from Malhotra Traders Rohtak. Suresh Chaudhary told that after examination the records it was found that the manufacturing firm has manufactured product in question Medical Device manufacturing license, wherein said company could be permitted to manufacture a disinfectant to disinfectant medical devices only as per serial No. 163 of medical device category list issued by CDSCO Department of MoHFW GOI, New Delhi on 01.11.2017.

Narender Ahooja told that the said company as labelled the product in question as hand disinfectant instead of medical device disinfectant to befool the general public at large for ulterior motive by printing MRP 630 Rs. Per 500 ml bottle.

Label is printed with indications:-

Hygienic Hand Disinfection: “Rub Bactorub Blue 3 Ml (2 pushes of pump), on clean dry hands and nail grooves for 30 Secs”.

Surgical Hand Disinfection: “Rub Bactorub Blue 9 Ml (6 pushes of pump), on clean dry hands up to elbows and nail grooves for 1.5-3 mins”.

“The manufacturer and dealers have contravened section 3 of EC Act, which is punishable under section 7 of the EC Act by manufacturing and stocking and selling the said sanitizers respectively” Ahooja added.

The FDA Haryana Team inspected the premises and records related to the sanitizer thoroughly and withdrawn the sample of the sanitizer and sent it for testing and analysis.

During Covid-19, pandemic wherefore this drug i.e. Hand sanitizer is essentially required by masses to prevent the deadly disease the person named above have done a serious offence under section 3 of EC Act punishable under section 7 of the EC Act.
